Popster is a mobile app, created by NUP TECHNOLOGIES P.C. Popster lets you create and discover short music videos using pre-recorded music, voice and video filters etc.

We welcome you to the Popster Application and to its general Services, either as a guest or a user, obtaining in any way access to above you a knowledge, agree and you are bound by these terms of use and you permit your consent.In any different case, do not connect and do not use the Services of Popster. These terms of use may be revised or modified or even new terms might be subjoined. You will be notified of the revised/modified/updated/new edition to the Terms of Use with a post to the Popster Application, which you should visit frequently and have to check for possible changes.The revised/modified/updated/new terms are activated since they post as the above of subsequence date, which will be precisely defined.If you continue to use the Services of Popster, automatically you agree, accept and consent the revised/modified/updated/new terms and you grant your consent.In any different case you should immediately discontinue and abstain from any use or visit to the application and its Services.

Creativity and Guidelines

Popster is a platform that celebrates creativity, allowing everyone to craft short music videos using various tools at their disposal, including exclusive beats from our collaborating producers and a range of voice and video effects.

Content Creation On Popster:

We encourage users to express themselves through music. Here's how you can contribute:

Singing: Create videos where you showcase your singing talent. You can choose music from our library, sing acapella, or even play your musical instrument.
Instrumental Performances: If singing isn't your forte, feel free to upload videos featuring your instrumental skills.

Content Rules

To ensure the quality and relevance of the content on our platform, we have some rules in place:

Content Relevance: Please only upload content related to singing or music. Videos unrelated to these themes will be promptly removed.

Videos and Ownership

We support our users in creating original music. Here's what you need to know about video ownership:

Song Rights: When you create a song using one of our beats, the rights are split evenly, 50/50, between you and the producer. We inform the producers whenever their music is used in a new song.
AI Lyrics: If you use AI-generated lyrics for your song, you retain 100% ownership of the lyrics. Our AI system is designed to inspire your creative process.
Sharing: You have the freedom to save your music videos to your device and share them on popular platforms like Instagram, TikTok, and Snapchat.
Videos belong to their creators. However, we have the right to use videos we choose for our social media accounts, marketing promotions, etc.

Covers

While we encourage original content, we understand that many artists enjoy covering songs. If you cover a song owned by someone else, please use the 'cover' toggle in the final step of video creation. Failure to do so will result in the removal of your video. Marking a song as a cover acknowledges that you do not hold the rights to that specific song, as it belongs to another artist. If the original rights owner requests its removal, we are obligated to comply.

Does Popster Own Any Rights?

Currently, Popster and NUP TECHNOLOGIES P.C. do not claim ownership rights over the songs created within the application. Songs belong entirely to their creators, with the exception of cover songs, and are shared 50/50 with our collaborating producers when our library's music is used. However, in the future, we may explore collaborations with artists to release full songs.

Does Popster Generate Revenue from Created Music?

No, at present, we do not generate any revenue. We are fully supported by our investors

Information you give us directly.

Registration information

When you sign up to use a Wink application, you provide us with basic information like your username, age and country. Your country is provided by Apple’s signup method.

Profile information

When you create a profile on a Popster Application, you provide us with information such as a profile picture, username, and your TikTok or/and Instagram handle as well as your Spotify link.

Device and App Activity Data

When you use the app, we automatically collect certain information about your device (such as the type of device, operating system, IP address, and unique identifiers). We use this information to improve the app, create new features, and keep our systems secure.

Videos

We collect the videos you send on popster together with the associated metadata such as the time the video was taken. We do not collect any location metadata from your videos. If you delete a video, we are immediately removing this video from our servers.

Inappropriate content

Keeping our community safe is our default. To make this happen, we are using AI services to prevent users from posting inappropriate pictures or texts before they publish them. You are not allowed to:

You are not allowed to post-hardcore sex scenes or pictures that show genitals. Our philosophy supports every movement that does not sexualize certain female body parts and that’s why we are very careful when we have to decide if a certain picture is allowed or not.
pretends to come from someone other than you or is impersonating someone else
is bullying someone or is intended to harass, scare or provoke anyone! We show zero tolerance in such behaviors and we ban such users immediately.
encourages dangerous or illegal activities or self-harm
is discriminating against somebody based on someone's sexuality, disability, gender, age, race or religion! We also show zero tolerance for any racist and homophobic behaviors.
infringes another individual’s privacy rights
is illegal, could expose popster to legal liability, or encourages people to get involved in anything which is illegal (for example, drugs, violence, or crime)
is defamatory or violates any third party’s rights, including breach of confidence, copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property right
competes with our Services or is spam
collects user content or information, or otherwise accesses the Services using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission
advertisements for commercial products and Services that are not approved by us and/or perform, advertise and promote any form of structural distribution measures (such as multi-level marketing or multi-level network marketing);
content in which you approach other users in an offensive and/or sexually-oriented way;

How we use your Data

We do not sell, rent, license, or lease your data to third parties. However, we may share it with the following third parties:

Legal and Safety – government authorities or regulators or other third parties where required by law or legal process or to protect our users’, or other third parties’ rights and safety.

Blacklist

To keep our community safe from offensive or troll accounts, we are using a “Blacklist” feature to make sure that users who are banned from Popster will not return with a new account. To get black listed, a user has to be offensive or racist to certain people or groups of people, share spam or inappropriate content, use fake credentials (such as fake school email address) or do not comply with our Terms of Use.

Your rights

You can delete your Popster account anytime. By deleting your account we are immediately removing your phone number, school email, username, IP address, unique identifiers and your photos. If your account has been “Blacklisted”, we are keeping the “Blacklisted” unique identifier to our “Blacklist’ data store to make sure that our community is safe.

These Terms of Use/Privacy and Policy are a contract between you and NUP TECHNOLOGIES P.C., 15125 Leoforos Kifisias 44, Marousi. NUP TECHNOLOGIES P.C. is the company that owns Popster Application
